Assess Exposure Early
Before Litigation
Companies can resolve employee legal claims more efficiently—and at far lower cost—through early, strategic evaluation of potential evidence.
Too often, employers fail to accurately assess exposure because they lack insight into how a plaintiff-side employment attorney will analyze and prosecute a case. As a result, legal risk is not fully understood until after years of litigation, high legal fees, discovery costs, and internal disruption. During that delay, employee damages continue to grow, settlement values increase, and litigation uncovers evidence further strengthening a plaintiff’s claim. If a case proceeds to trial and the plaintiff prevails, employers may also face responsibility for the plaintiff’s attorney’s fees and additional appellate costs.
Strategic Advantage:
An Insider’s Perspective
We provide the strategic insight for evaluating employment-related risk so your company can pursue a cost-effective resolution before a lawsuit is filed.
Wenke Employment Risk Consulting works collaboratively with your company’s Human Resources professionals, in-house counsel, or outside counsel to identify the documents a plaintiff’s attorney is likely to demand in litigation, the potential witnesses and comparators, and the types of questions those witnesses can expect to face in depositions. We do not provide legal advice, but rather the strategic insight for evaluating employment-related risk. In short, your company will gain an “insider’s perspective” — drawn from the experience of a seasoned and successful plaintiff-side employment attorney, on how employment claims are evaluated, developed, and prosecuted in litigation allowing your company to pursue an informed and cost-effective resolution before a lawsuit is filed.
